Official Rules for the trivago Guy Photo Contest

No purchase necessary. A purchase will not increase your chances of winning.

1. Eligibility

The Contest is open only to legal residents of the United States who are at least eighteen (18) years old. Employees of trivago GmbH (“Sponsor”), as well as the immediate family (spouse, parents, siblings, and children) and household members of those employees, are not eligible to enter.

2. Entry Period

The Entry Period begins at 3:00 AM ET on August 18, 2014 and ends at 3:00AM ET on August 24, 2014. Sponsor’s computer is the official time-keeping device for the Contest.

3. How to Enter

  • a. Take a Picture: Take a picture of yourself (or have someone take a picture of you) wearing an outfit that you’d like to see the Trivago Guy wearing in the next commercial (your “Entry”). Please make sure your Entry does not: (i) contain any content that is indecent or inappropriate, as determined by Sponsor, in its sole discretion; (ii) prominently feature any trademarks; (iii) violate anyone’s rights, including, but not limited to, copyrights or rights of privacy and publicity; or (iv) portray Sponsor or its services in a negative light.
  • b. Submit Your Entry: You have three options. To enter on Facebook, visit our page, like us, if you don’t already, click on the tab for the Contest page, and submit your Entry. To enter on Twitter or Instagram, simply post your Entry with the hashtag #trivagoGuy. Sponsor reserves the right to reject any Entry that does not comply with these Official Rules.
  • c. Representations and Warranties: By entering, you represent and warrant that: (i) you agree to these Official Rules and Sponsor’s decisions regarding the Contest, which are final and binding; (ii) you own all rights to the Entry; and (iii) your Entry does not violate any third party’s rights.

4. Sponsor’s Rights to Entries

You do not transfer ownership of your Entry by entering the Contest. However, by entering, you: (a) grant Sponsor, its agents, licensees, and assigns an irrevocable, perpetual (non-exclusive) right and permission to reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, modify, create derivative works of, exhibit, and otherwise use your Entry as-is or as-edited (with or without using your name) in any media throughout the world for any purpose, without limitation, and without additional review, compensation, or approval from you or any other party; (b) forever waive any rights of copyrights, trademark rights, privacy rights, and any other legal or moral rights that may preclude Sponsor’s use of your Entry, or require any further permission for Sponsor to use the Entry; and (c) agree not to instigate, support, maintain, or authorize any action, claim, or lawsuit against Sponsor on the grounds that any use of the Entry, or any derivative works, infringes any of your rights as creator of the Entry, including, without limitation, copyrights, trademark rights, and moral rights.

5. Winner Selection Process

  • a. Finalists: After the Entry Period, a panel of judges will evaluate all entries based on the following Judging Criteria: originality; creativity; and overall alignment with the trivago brand. Sponsor will choose the six (6) Finalists that best meet the criteria. If a Finalist entered on Twitter or Instagram, Sponsor will contact him/her on or about August 25, 2014 and require him/her to agree to these Official Rules. (Facebook entrants will be asked to agree upon entry.) Finalists will have one (1) day to respond. If a Finalist does not respond in time, Sponsor reserves the right to select an alternate Finalist based on the criteria above.
  • b. Voting: The Finalists will be posted in a gallery on Sponsor’s Facebook page between August 28, 2014 and September 4, 2014. Members of the public will be invited to vote for their favorite Entry based on the Judging Criteria. There is a limit of one (1) vote per person per day, and individuals may not use multiple Facebook accounts to vote. The Finalist with the highest number of votes shall be deemed the winner. In the event of a tie, the Finalist with the highest score from Sponsor shall be deemed the winner.
  • c. Voting Process: You may not attempt to obtain votes by any fraudulent or inappropriate means, including, without limitation, by: (i) circumventing (or encouraging others to circumvent) the vote limits; (ii) using any automated system to vote; or (iii) offering any inducements to others in exchange for votes. Sponsor, in its sole discretion, reserves the right to reject any votes obtained through fraudulent or inappropriate means.

6. Potential Winner Requirements

Sponsor will attempt to notify the potential winner within five (5) days of selection. Except where prohibited, a potential winner may be required to complete and return a declaration of eligibility and liability/publicity release. If a potential winner fails to sign and return these documents within the required time period, Sponsor may select an alternate potential winner in his/her place according to the criteria described above.

7. Prize

One (1) winner will receive a trip to Berlin to attend the shooting of the next trivago commercial. The prize consists of: (a) round-trip coach class airfare from an international airport near the winner’s home to Berlin; (b) double-occupancy hotel accommodations for five (5) nights; and (c) a stipend of $500 to help cover additional expenses.

The trip will take place at some point during the last two weeks of September, but the winner will be given an exact date at the time of notification. The approximate retail value of the prize is $4,500. The actual value of the prize will vary depending on various factors, including the point of departure and dates of travel.

The winner is responsible for paying any costs and expenses not listed above. The winner must have a valid passport and be able to travel on the dates specified by Sponsor. Any prize details not specified above will be determined by Sponsor, in its sole discretion. A prize may not be transferred and must be accepted as awarded. The winner may not request cash or a substitute prize; however, Sponsor reserves the right to substitute a prize with another prize of equal or greater value if the prize is not available for any reason, as determined by Sponsor, in its sole discretion.

The value of the prize will treated as income to a winner and the winner will be responsible for payment and reporting of all applicable taxes. We encourage you to consult your tax advisor to determine how winning a prize may affect your tax obligations.

8. General Conditions

In the event that the operation, security, or administration of the Contest is impaired in any way, Sponsor may, in its sole discretion, either: (a) suspend the Contest to address the impairment and then resume the Contest; or (b) award the prize according to the criteria set forth above from among the eligible entries received up to the time of the impairment (with or without reference to the public votes).

Sponsor reserves the right, in its sole discretion, to disqualify and seek damages from any individual who tampers with the operation of the Contest, violates these Official Rules, or acts in a disruptive or unsportsmanlike manner. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Proof of sending any communication to Sponsor by mail shall not be deemed proof of receipt of that communication by Sponsor. The Contest is subject to federal, state, and local laws and regulations, and is void where prohibited.

9. Release and Limitations of Liability

By entering, you agree to release and hold harmless Sponsor, Expedia, Inc., Facebook, Twitter, Instagram, their respective parents, subsidiaries, affiliates, and each of their respective officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Contest or receipt or use of any prize, including, but not limited to:

(a) unauthorized human intervention in the Contest (including the voting process); (b) technical errors related to computers, servers, providers, or telephone, or network lines; (c) any errors on the Facebook platforms that may impact entry or voting; (d) printing errors; (e) lost, late, postage-due, misdirected, or undeliverable mail; (f) errors in the administration of the Contest or the processing of entries; or (g) injury or damage to persons or property. You further agree that in any cause of action, in no event shall the Released Parties be liable for attorney’s fees. You waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

10. Disputes

You agree that any and all disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in New York. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of the Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of New York, without giving effect to any choice of law or conflict of law rules (whether of New York or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than New York.

The Contest is sponsored by trivago GmbH, 140 Broadway, 46th Floor, New York, NY 10005. The Contest is not sponsored by, endorsed by, administered by, or associated with Facebook, Twitter, or Instagram.

12. Results

The winner will be announced on the Facebook Contest page.
